BREAK TIME: Know Your Rights; Exercise Your Rights

YOU* ARE CONTRACTUALLY ENTITLED TO:
  • One 30 minute paid break
  • One 15 minute paid break
  • One 60 minute unpaid break
(See collective bargaining agreement, Article XI, section 2, pages 34, 35)

* Provided you work an 11.5 hour shift

Breaks are important and necessary. The hospital administration must provide breaks - it is your contractual right.

If you have been denied your rights under the collective bargaining agreement, then a violation has occurred and a grievance must be filed. NYPNU will file a grievance for each and every violation that we are made aware of. Class Action grievances may also be filed.

If you are being denied your rights, fill out a "Break time Grievance Form" (you can print one out by going to the Member's Only section of this web site) and return it to your delegate or the Union office as soon as possible. You can also obtain a Break Time Grievance form from a delegate or pick one up from the NYPNU office.

Make sure to advise your supervisor of the violation as it is happening so that she/he has the opportunity to correct the problem. Please note that a break given in a less than ideal time of shift is not a denied break.
