Validation Day Isn't Valid as Mandatory Overtime

The Hospital is requiring all nurses to attend a "Nursing Validation Day" training session this year. Lenox Hill Hospital can require employees to receive training, but they cannot require a nurse, under any circumstances, to take the class as overtime.

Nurses may volunteer to attend the "Nursing Competency Validation Day" on their day off if they so choose. Nurses cannot be compelled and/or coerced into attending the validation day on their own time. Such action would be considered mandatory overtime, a clear and direct violation of Article XIII, section 3 of the collective bargaining agreement. Nurses who do not volunteer to attend the validation day on their own time can be scheduled to attend the classes on one of their own regularly scheduled shifts to work. This applies to all nurses on every shift.

If any nurse is forced to do overtime, it is a grievance that we will want to file immediately.
